Plain English Summary

You approve a quote and pay a 25% deposit to begin. Deposits are non-refundable. Pay within 14 days. You own final work once paid in full (for business use), but you can't resell it. We provide two weeks of complimentary support. Ongoing support requires a subscription. We're not responsible for third-party platform issues or indirect losses.

1. Our Agreement

Engagement begins when you approve a written quote and pay a 25% deposit. Delays caused by late content, approvals or feedback may extend timelines.

2. Payments and Fees

A 25% deposit is required upfront unless otherwise agreed in writing. The remaining balance is due upon completion. Payment is required within 14 days of invoice issue. Late payments may incur a reasonable administration fee. Grow & Support Plan requires an active subscription.

3. Ownership & Intellectual Property

All work remains our property until full payment is received. Upon full payment, you receive a non-exclusive, royalty-free licence for business use. You may not resell or redistribute work without written permission. We may showcase completed work unless confidentiality is requested.

4. Advertising Accounts

Advertising accounts created by us are managed by The Daly Creative on behalf of the client. Transfer requests must be agreed in writing and may incur administrative fees.

5. Third-Party Platforms

We may use platforms including Wix, WordPress, Squarespace, Google Workspace, GitHub, GoDaddy, Cloudflare, Shopify, Webflow and others. We are not responsible for outages, policy changes, or pricing changes from these providers.

6. Support

Two weeks complimentary support for bug fixes following completion. Grow & Support Plan may be cancelled with 30 days' written notice.

7. Limitation of Liability

Liability is limited to fees paid for the relevant service. We are not liable for indirect or consequential losses.

8. Governing Law

Governed by the laws of Western Australia, Australia.
